TALES OF TILLAMOOK
OFFICIAL RULES AND SUBMISSION TERMS
Tillamook County Creamery Association (“TCCA”, “us”, or “our”) wants to hear your Tales of Tillamook! These Official Rules and Submission Terms describe the terms and conditions for submitting your story, photo, and/or video (“collectively referred to as “Story” or “Stories”) to the TCCA website (“Website”). BY SUBMITTING YOUR STORY, YOU REPRESENT THAT YOUR STORY IS BASED ON YOUR OWN OPINION AND EXPERIENCE WITH TCCA AND OUR PRODUCTS AND YOU ACCEPT AND AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS IN THESE OFFICIAL RULES AND SUBMISSION TERMS.
1. STORY SUBMISSION
You must be at least 18 years old to submit a Story. If you’re under the age of 18 years old, a parent or guardian must submit the Story on your behalf. To submit a Story you must provide certain information such as, but not limited to, your name, email address, city, and state. All the information you provide must be correct, current, and complete.
2. STORY REPRESENTATIONS AND WARRANTIES
Each Story must be submitted by the original creator and owner of all content included in the Story. You must be, and your Story submission is your representation and warranty to us that you are, the sole author and owner of the copyright and other intellectual property and proprietary rights in and to the Story submitted. In addition, by submitting a Story, you represent and warrant that the Story you submit: (i) does not infringe, misappropriate, or otherwise violate any other person’s or entity’s copyrights, trademark rights, trade secret rights, confidentiality, other intellectual property or proprietary rights, rights of privacy or publicity, or any other rights; and (ii) does not contain material that is unlawful or in violation of or contrary to any applicable laws or regulations. You further represent and warrant that you have secured all consents and approvals in writing from any persons featured in any Story submitted, and acknowledge and agree that, upon request from TCCA, you will provide such written consents and approvals to TCCA and secure any additional written consents, approvals, or releases required by TCCA from any persons featured in such Story. You shall be solely liable for any damages resulting from any infringement or misappropriation of copyright, trademark, or other intellectual property or proprietary right, rights of privacy or publicity, or any other rights, or any other harm resulting from your Story submission or our use thereof.
3. WHAT HAPPENS IF WE FEATURE YOUR STORY
If TCCA decides to use your Story, whether on the Website, our social media pages, at the Tillamook Creamery or other physical locations, by email, or in any other media, TCCA will attempt to notify you within thirty (30) days of your submission. We ask that you respond to our notification within seven (7) days. We will request that you and any other people featured in your Story sign a media release. NOT ALL STORIES WILL BE FEATURED. EVEN IF WE CONTACT YOU FOR RELEASES AND THEY ARE PROVIDED, THERE IS NO GUARANTEE YOUR STORY WILL BE USED. YOU ACKNOWLEDGE AND AGREE THAT YOU WILL NOT RECEIVE ANY MONETARY OR OTHER CONSIDERATION FOR OUR USE OF YOUR STORY.
4. CONTENT STANDARDS
The following content standards apply to all Story submissions. Submissions must comply with all applicable laws and regulations. Without limiting the foregoing, Stories must not:
Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, threatening (including any content suggestive of stalking), or otherwise objectionable;
Contain or promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, age, or any other protected characteristics;
Infringe any trademark, trade secret, copyright, or other intellectual property or proprietary right, rights of privacy or publicity, or other rights of any other person;
Include any private or confidential information, including without limitation addresses, telephone numbers, credit card numbers, Social Security numbers, or driver’s license numbers;
Contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Official Rules and Submission Terms or our Privacy Policy;
Contain any computer viruses, worms, or other potentially damaging computer programs or files;
Promote any illegal activity, or advocate, promote, or assist any unlawful act;
Cause annoyance, inconvenience, or anxiety or be likely to upset, embarrass, alarm, or annoy any other person;
Impersonate any person or misrepresent your identity or affiliation with any person or organization; or
Involve unauthorized commercial activities or sales, such as contests, sweepstakes, or other sales promotions, barter, junk mail, spam, chain letters, pyramid schemes, or advertising for products or services offered by others.
5. INTELLECTUAL PROPERTY RIGHTS
For any Story that you submit, you grant TCCA a perpetual, irrevocable, royalty-free, transferable, and sublicensable right and license to use, reproduce, modify, prepare derivative works based upon, adapt, publish, translate, distribute, perform and display such Stories, and/or incorporate such Stories, in any form, media, or technology throughout the world, without compensation to you.
6. INDEMNIFICATION
You agree to indemnify and hold TCCA (and its subsidiaries, affiliates, successors, assigns and licensees, and each of their respective officers, directors, members, agents, and employees), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, including reasonable attorneys’ fees, arising out of: (a) your breach of these Official Rules and Submission Terms; (b) your Story, including TCCA’s use thereof; or (c) your violation of any law or the rights of any third party.
8. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TCCA OR OUR AFFILIATES, OR OUR OR THEIR LICENSORS, LICENSEES, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OWNERS, DIRECTORS, OR REPRESENTATIVES BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR SUBMISSION OF ANY STORY OR OUR USE OF ANY STORY YOU SUBMIT, YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR ANY SERVICES LINKED TO THE WEBSITE, OR ANY CONTENT ON THE WEBSITE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, OR LOSS OF DATA, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
9. RELEASE
You hereby agree to release and discharge TCCA (and its subsidiaries, affiliates, successors, assigns and licensees, and each of their respective officers, directors, members, agents, and employees) for and from any and all claims, demands or causes of action arising out of or relating to any use, reproduction, modification, adaptation, publication, translation, distribution, performance or display of your Story or your name or likeness, including, without limitation, invasion of privacy or right of publicity, infringement of copyright or violation of any other right, inadvertent errors, blurring, distortion or alteration, or based upon any failure or omission to make use thereof.
10 ADDITIONAL RIGHTS
No compensation will be paid for submission or use of any Story. TCCA is under no obligation to post or use any Story you may submit and TCCA may remove or take-down any Story at any time for any or no reason in TCCA’s sole discretion. In the event TCCA removes any Story posted or displayed on TCCA’s website, social media accounts or channels, or other TCCA properties, TCCA retains the right to use your Story and reserves the right to disclose any Story as necessary to satisfy any applicable law, regulation, legal process, or governmental request, or to otherwise use the Story in any manner. You are solely responsible for your conduct relating to any Story you submit, or that you allow others to submit under your name.
11. MONITORING AND ENFORCEMENT
Without limiting any other rights TCCA may have, TCCA specifically has the right, but not the obligation, to:
Remove or refuse to post any Story for any or no reason in our sole discretion;
Take any action with respect to any Story that we deem necessary or appropriate in our sole discretion, including if we believe that such Story violates these Official Rules and Submission Terms or the Website Terms of Use, including the content standards, infringes any intellectual property right, privacy right, or other right of any person or entity, threatens the personal safety of the public, or could otherwise create liability for TCCA;
Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy;
Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Website; and
Terminate or suspend your access to all or part of the Website for any reason, including without limitation, for any violation of these Official Rules and Submission Terms or Website Terms of Use.
Without limiting the foregoing, we have the right to cooperate fully with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone submitting a Story. YOU RELEASE AND HOLD HARMLESS TCCA AND OUR SUBSIDIARIES, AFFILIATES, SUCCESSORS, ASSIGNS, LICENSORS, LICENSEES, SERVICE PROVIDERS, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, AGENTS AND EMPLOYEES FOR AND FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES DURING, OR TAKEN AS A CONSEQUENCE OF, INVESTIGATIONS BY LAW ENFORCEMENT AUTHORITIES.

13. TCCA’S WEBSITE TERMS
In addition to these Official Rules and Submission Terms, your use of our Website is subject to our Website Terms of Use at https://www.tillamook.com/terms-of-use, and in the case of any conflict, these Official Rules and Submission Terms will control.
No purchase or payment of any kind is necessary to SUBMIT A STORY. Story submission period: Begins 12:01AM PST on February 3, 2025, and ends at 11:59 PST on December, 31, 2025.
